1. Acceptance of Terms
By accessing or using our on-demand webinar service, you agree to comply with and be bound by these Terms of Service. If you disagree with these terms, please do not use the service.
2. Corporate User Account
You will need to create a corporate user account to access certain service features. You are responsible for maintaining the confidentiality of your account information and are fully responsible for all activities that occur under your account.
3. On-demand webinar content
a. The content available on our platform is for personal, non-commercial use only.
b. You may not download, reproduce, distribute, transmit, broadcast, display, sell, license, or otherwise exploit any content for any other purposes without prior written consent.
4. Viewing Packages
a. Packages purchased include an allocated number of views that individual users can access.
b. A package expires when:
i) all allocated number of views purchased have been accessed
ii) or where all views have not been used, 12 months after the package purchase date.
c. A view is when an individual user registers to access the content using the link we have provided to the Corporate User
d. An individual user will have 72 hours to access the content and print a completion certificate. Extensions of time and certificate access will not be possible after the time has lapsed.
e. Once an individual user has registered to access the content, we cannot transfer that view to another individual user.
f. Corporate users may request a report of ‘views’ no more than three (3) times.
5. Payment and Billing
Corporate users will be billed in advance. Following receipt of payment, we will provide the corporate user with a unique link to the content purchased within the package. No refunds will be given for unused or partially used views or where access has been terminated in accordance with clause 6. Termination.
6. Termination
We reserve the right to terminate or suspend your account and access to the service at our sole discretion, without notice, for any conduct that we, in our sole discretion, believe violates these Terms of Service or is harmful to other users of the service or to us. This also applies to individual users who violate the terms of service for individual users.
7. Disclaimer of Warranties
The service is provided on an “as is” and “as available” basis without any warranties of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
8. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall we be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from (a) your use or inability to use the service; (b) any unauthorised access to or use of our servers and/or any personal information stored therein; (c) the content available on the service, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of any content posted, transmitted, or otherwise made available via the service, even if advised of their possibility.
You acknowledge and agree that we do not assume any responsibility or liability for the accuracy, completeness, legality, reliability, or usefulness of any content available on the service. We disclaim any responsibility for the deletion, failure to store, misdelivery, or untimely delivery of any content. You are solely responsible for your use of the content and any consequences thereof.
9. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of Australia. Any disputes arising under or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Australia.
10. Intellectual Property
a. Our Rights: All intellectual property rights, including copyrights, trademarks, patents, and trade secrets, in connection with the service and its content owned by or licensed to us. You acknowledge and agree that the service and any necessary software used in connection with the service contain proprietary and confidential information that is protected by applicable intellectual property and other laws.
b. Usage Restrictions: You agree not to record, broadcast, modify, rent, lease, loan, sell, distribute or create derivative works based on the service or any content, in whole or in part, unless you have been specifically permitted to do so by us.
11. Changes to Terms of Service and reserves the right, at our sole discretion, to modify or replace these Terms of Service at any time.
By continuing to access or use our service after those revisions become effective, you agree to be bound by the revised terms. If you disagree with the new terms, please stop using the service.
By using our on-demand webinar service, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, including the provisions related to intellectual property rights.
